Welcome to Tradie Agent ("Service"). These Terms and Conditions ("Terms") form a legally binding agreement between you ("User," "you") and [company_name], a company registered in [country/region] ("Company," "we," "us," "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Account Terms

Eligibility: You must be at least 18 years old to use the Service.

Account Security: You are responsible for keeping your login credentials secure and for all activity under your account.

Accuracy of Information: You agree to provide true, current, and complete information, and to keep it updated at all times.

User Obligations: You agree not to use the Service for any unlawful, infringing, fraudulent, or malicious purposes.

2. Subscription, Fees, and Payment
  • Subscription: Access to core features of Tradie requires an active paid subscription.

  • Free Trial: We offer a 14-day free trial. During the trial period, you will not be charged. At the end of the trial, your subscription will automatically start and your payment method will be charged unless you cancel before the trial ends.

  • Billing: Subscription fees are charged in advance on a recurring monthly basis (or other billing period if specified). Subscriptions automatically renew unless canceled before the renewal date.

  • Payment Processing: Payments are processed by third-party providers (e.g., Stripe). We do not store your full credit card or payment details.

  • Refunds: No refunds are provided for partial or unused subscription periods unless required by law.

  • Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the end of your current billing cycle.

3. Use of Service

AI Features: Tradie uses AI to answer, transcribe, and process phone calls. Accuracy may vary depending on call quality, accents, and other factors. We do not guarantee that the AI responses will be completely accurate or that every call will be successfully forwarded.

Call Forwarding: You are responsible for enabling or disabling call forwarding with your telecom provider. Our interface may assist in managing this process but does not control your telecom provider’s systems.

Call Recording Compliance: Calls may be recorded and transcribed. You are solely responsible for complying with all applicable call-recording and privacy laws in your jurisdiction (e.g., notifying callers and obtaining consent where required).

4. User Content and Data

Ownership: You retain ownership of your customer data, including call recordings, transcripts, and contact information ("User Content").

License: You grant us a limited, non-exclusive license to process, store, and use User Content only to provide and improve the Service.

Data Deletion: You may delete individual records from your account. Permanently deleted data cannot be recovered. You may also request complete deletion of your account and data by contacting us at [contact_email].

5. Intellectual Property

All rights, title, and interest in and to the Service (including but not limited to the software, design, logos, trademarks, and documentation) are owned by us, except for User Content. You may not copy, distribute, modify, reverse engineer, or resell any part of the Service.

6. Third-Party Services

We are not responsible for any losses, damages, or issues caused by third-party services used to provide the Service, including but not limited to Stripe (payment processing), Twilio or Telnyx (telecommunications), and Google Cloud Platform (hosting).

7. Termination

By You: You may cancel your subscription at any time. Service access will remain active until the end of the billing cycle.

By Us: We may suspend or terminate your account immediately if you breach these Terms, misuse the Service, or engage in activities that may harm the Service or other users.

8. Disclaimer and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including loss of revenue, customers, or opportunities, arising out of your use of the Service.

We are not responsible for issues caused by third-party services, including but not limited to telecom providers, AI services, cloud hosting providers, or payment processors.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
